1. Acceptance of Terms
By accessing our website, making a reservation, or using our transportation services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.
Mary Luxury Transport reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of our services following any changes constitutes acceptance of the revised terms.
2. Definitions
In these Terms & Conditions, the following terms have the meanings set forth below:
“Mary Luxury Transport,” “we,” “our,” “us” refers to Mary Luxury Transport, its owners, employees, and authorized agents.
“Client,” “you,” “your” refers to the individual or entity booking and/or using our services.
“Service” refers to chauffeur-driven luxury transportation provided by Mary Luxury Transport.
“Vehicle” refers to any sedan, SUV, Sprinter, limousine, or other transportation asset operated by Mary Luxury Transport.
“Chauffeur” refers to the licensed, trained professional operator of the vehicle.
“Reservation” refers to a confirmed booking for transportation services.
“Bay Area” refers to the San Francisco Bay Area, including San Francisco, Oakland, San Jose, and surrounding cities.
“Airport Transfer” refers to transportation to or from SFO, OAK, or SJC airports.
3. Booking and Reservations
3.1 Making a Reservation: All reservations must be made through our official website, by phone, or by email. Reservations are subject to vehicle and chauffeur availability. A reservation is not confirmed until you receive a confirmation email or number from us. We recommend booking at least 24-48 hours in advance for standard trips, and 2-4 weeks in advance for events and corporate group travel .
3.2 Accuracy of Information: You are responsible for providing accurate, complete, and current information when making a reservation, including but not limited to pickup and drop-off addresses, date and time, passenger count, luggage count, flight numbers, and special requests. Failure to provide accurate information may result in service delays, additional charges, or cancellation. Mary Luxury Transport is not liable for any losses incurred due to inaccurate information provided by the client .
3.3 Special Requests: Special requests (including child seats, pet accommodations, additional stops, and luggage handling) must be made at the time of booking. While we strive to accommodate all requests, they are subject to availability and may incur additional charges.
3.4 Confirmations: A confirmation email containing trip details will be sent to the email address provided at booking. You are responsible for reviewing this confirmation and notifying us immediately of any errors. For reservations made through third parties, you must refer to their confirmation procedures.
4. Service Scope and Modifications
4.1 Service Scope: Our services include point-to-point transportation, hourly service, airport transfers, and special event transportation within the Bay Area and beyond as agreed at booking. All services are subject to the vehicle, chauffeur, and time specified in your confirmation .
4.2 Modifications: Changes to reservation details (pickup time, location, vehicle type, or destination) are subject to availability and must be communicated to us at least 2 hours prior to scheduled pickup time for standard trips . Modifications may incur additional charges or rate adjustments.
4.3 Waiting Time: For airport transfers, we provide 45-60 minutes of complimentary waiting time from the flight’s actual landing time. Wait time beyond this grace period, including for general pickups (15-minute grace), will be billed at the hourly rate of your vehicle category in 15-minute increments .
4.4 Route Selection: Your chauffeur will select the most appropriate route based on current traffic and road conditions to ensure the safest and most efficient journey . Routes may vary from GPS estimates due to real-time conditions.
5. Rates and Payment
5.1 Rates: All rates quoted are fixed at the time of booking and include the base fare, chauffeur time, fuel, applicable tolls (including Bay Bridge tolls), and local taxes unless otherwise stated. We do not charge surge pricing or hidden fees . Rates are subject to change without prior notice, but any confirmed reservation will be honored at the rate quoted at booking.
5.2 Payment: Full payment is required at the time of booking to confirm your reservation. We accept all major credit cards (Visa, Mastercard, American Express, Discover) and PayPal. For corporate accounts, net-30 invoicing may be available with approved credit.
5.3 Corporate Accounts: Corporate accounts with invoicing and net-30 terms require prior approval. A dedicated account manager will facilitate billing, with cost-center breakdowns available upon request. Account agreements are governed by these Terms & Conditions.
5.4 Security: All payments are processed through our encrypted, secure payment gateway. We do not store payment information on our servers .
6. Cancellations and Refunds
6.1 Cancellation by Client
24+ hours before scheduled pickup: Full refund or credit toward future service
24 to 2 hours before scheduled pickup: 50% of booking value charged (remaining balance refunded)
Less than 2 hours before pickup or no-show: 100% of booking value charged
6.2 Cancellation by Mary Luxury Transport: If we are unable to provide the agreed-upon service for reasons including but not limited to vehicle breakdown or chauffeur unavailability, we will make every effort to provide a suitable alternative (a comparable vehicle at no extra charge). If an alternative cannot be provided, you will receive a full refund of all amounts paid. Beyond this refund, our liability is limited to the amount paid for the booking.
6.3 No-Show: A no-show occurs when you do not appear at the designated pickup location within the grace period and do not contact us to cancel or reschedule. No-shows are charged 100% of the booking value.
6.4 Refund Processing: Approved refunds will be processed within 7-10 business days to the original payment method used at booking. Refunds for corporate account bookings may follow different timelines based on the agreed payment structure.
7. Client Responsibilities
7.1 Accurate Information: You are responsible for providing accurate pickup location, destination, passenger count, and contact information. Any errors or omissions that cause delays or additional charges are your responsibility .
7.2 Punctuality: You are expected to be ready for pickup at the scheduled time. For non-airport pickups, a 15-minute grace period applies. The chauffeur will wait for you at the designated pickup location. If you are running late, please contact us immediately. Extended waiting may incur additional charges.
7.3 Behavior on Vehicles: You agree to conduct yourself in a respectful, safe, and lawful manner while in our vehicles. We reserve the right to terminate service immediately without refund for any behavior that, in our sole discretion, endangers the safety of the chauffeur, the vehicle, or other passengers, or violates any law or regulation .
7.4 Luggage and Personal Items: You are responsible for your luggage and personal belongings at all times. We recommend keeping valuables with you. Mary Luxury Transport is not responsible for lost, stolen, or damaged personal items, including luggage left in vehicles.
7.5 Damage to Vehicles: You are responsible for any damage to our vehicles caused by you or your passengers, including but not limited to spills, staining, burns, and breakage. A cleaning fee of $75-$150 may apply for excessive mess requiring additional cleaning. For damage beyond cleaning, the full cost of repair or replacement will be charged to your payment method.
7.6 Smoking and Prohibited Items: All Mary Luxury Transport vehicles are strictly non-smoking. This includes tobacco, e-cigarettes, and vaping devices. Alcohol consumption is permitted only with prior approval for special events. Alcohol is not permitted in non-event standard service unless we are legally able to provide it. Illegal substances are strictly prohibited in all vehicles. Violations may result in immediate termination of service without refund and notification of law enforcement.
8. Chauffeur Conduct and Limitations
8.1 Professional Conduct: Our chauffeurs are trained to provide professional, courteous, and safe service. They are uniformed, licensed, background-checked, and insured.
8.2 Chauffeur Authority: The chauffeur has the final authority to determine if it is safe to proceed with or continue the booked service. This includes refusal to operate the vehicle if the client or passengers are intoxicated, aggressive, or otherwise in a condition that reasonably presents a safety risk. The chauffeur may stop the ride and require all passengers to exit if, in their judgment, continued service is unsafe.
8.3 Special Assistance: While our chauffeurs are happy to assist with luggage and offer a welcoming and professional experience, they are not required to provide physical assistance for passengers with disabilities beyond what is safe and reasonable. Where special physical assistance is required, we encourage clients to book with a companion or make specific arrangements in advance.
9. Liability and Limitations
9.1 Limitation of Liability: Mary Luxury Transport is not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or in connection with our services. Our total liability for any claim arising out of or relating to these Terms & Conditions or our services shall not exceed the total amount paid by you for the specific booking giving rise to the claim.
9.2 Delays and Interruptions: We are not liable for delays or interruptions to our services caused by circumstances beyond our reasonable control, including but not limited to:
Traffic accidents, road closures, or construction
Acts of nature (weather, earthquakes, floods)
Mechanical breakdowns (though we will make reasonable efforts to provide alternative service)
Public health emergencies
Airline delays, cancellations, or security incidents
Government-mandated restrictions
Terrorism, civil unrest, or military action
Strikes or labor actions
Technology failures (including booking platform downtime)
9.3 Third-Party Services: Mary Luxury Transport is not responsible for the acts or omissions of any third parties, including but not limited to airlines, hotels, venues, or other transportation providers. We are not liable for missed flights, appointments, or events due to delays. We strongly recommend allowing ample time for airport and event travel.
9.4 Luggage and Personal Items: Mary Luxury Transport is not responsible for lost, stolen, or damaged personal property. We recommend that you carry valuable items with you.
10. Intellectual Property
10.1 Ownership: All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Mary Luxury Transport or its content suppliers and is protected by copyright and intellectual property laws.
10.2 Use of Content: You may not reproduce, modify, distribute, or otherwise use any of our content without our express written permission. Unauthorized use may violate applicable laws.
11. Privacy
11.1 Personal Information: Mary Luxury Transport collects and processes personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
11.2 Security: We implement industry-standard security measures to protect your personal information. However, no method of electronic transmission is 100% secure, and we cannot guarantee absolute security.
12. Governing Law and Dispute Resolution
12.1 Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
12.2 Jurisdiction: Any disputes arising out of or relating to these Terms & Conditions or our services shall be brought exclusively in the state and federal courts located in Alameda County, California. You consent to the exclusive jurisdiction of such courts.
12.3 Dispute Resolution: If you have a concern or dispute with Mary Luxury Transport, please contact us directly. We will make reasonable efforts to resolve any issue informally and in good faith.
13. Severability
If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms & Conditions, together with your booking confirmation and any other documents referenced herein, constitute the entire agreement between you and Mary Luxury Transport regarding our services. This agreement supersedes all prior and contemporaneous understandings, communications, and agreements, whether written or oral.
